Parents with deaf children have a nearly two-decade relationship with special education staff and providers in their respective school district. It is important for parents to understand the full range of services available to their deaf or hard of hearing child under federal laws, particularly the Individuals with Disabilities Education Act. The law provides very specific rights for deaf and hard of hearing children including but not limited to: a free and appropriate public education (FAPE), least restrictive environment (LRE), Individualized Education Program (IEP), continuum of placement options, and many other important terms, concepts and rules. Parents need to be fully prepared and familiar with these terms, concepts and rules throughout their deaf or hard of hearing child’s education. Parents also need to understand their ability and right to agree or disagree with the special education team on any proposed program or service on their child’s IEP. This includes the right to challenge educational placements and IEP goals determined by the special education team. As a last resort, parents have the option of filing a due process hearing request to challenge any IEP proposed by the special education team. Participants will leave this presentation with a good grasp of special education rights for deaf and hard of hearing children.
